1. Service Description

Yummy ("we", "us", or "our") provides an AI-powered meal planning service through the website yummy.cloud and the Yummy mobile application (collectively, the "Service"). The Service enables users to generate personalized weekly meal plans, shopping lists, and compare supermarket prices using artificial intelligence.

2. Account Registration

• You must provide a valid email address and create a password, or sign in via Google OAuth, to use the Service.
• Each account is intended for a single individual. You may not share your account credentials with others.
• You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.
• You must be at least 16 years of age to create an account.

3. Subscription Tiers

The Service is offered in three tiers:

• Free: Limited to 2 plan generations per month, 7 meals per plan, 2 household members, and 1 supermarket for price comparison. Editing plans, regenerating meals, and editing shopping lists are not available.
• Premium: Up to 10 plan generations per month, 40 meals per plan, 8 household members, and 3 supermarkets for price comparison. Includes full editing and regeneration capabilities.
• Pro: Unlimited plan generations, meals, household members, and supermarkets. Includes all Premium features.

We reserve the right to modify tier limits, features, and pricing with reasonable notice.

4. AI-Generated Content Disclaimer

Meal plans, recipes, nutritional estimates (including calorie counts), and shopping lists generated by the Service are produced by artificial intelligence and are provided for informational purposes only.

This content does not constitute medical, nutritional, or dietary advice. Calorie estimates are approximate and may vary based on actual ingredients, preparation methods, and portion sizes. If you have specific dietary requirements, allergies, or health conditions, consult a qualified healthcare professional before following any AI-generated meal plan.

We do not guarantee the accuracy, completeness, or suitability of any AI-generated content for your specific circumstances.

5. Supermarket Prices

Supermarket product prices displayed in the Service are obtained through automated data collection and are provided as estimates for comparison purposes only. Actual in-store or online prices may differ due to regional variations, promotions, stock availability, or timing differences between when prices were collected and when you view them.

We do not guarantee the accuracy of any displayed prices and are not responsible for any discrepancies between displayed and actual prices.

6. Payment Terms

• All payments are processed securely through Stripe. We do not store your credit card information.
• Subscriptions are billed on a recurring basis (monthly or annually) and will automatically renew unless canceled before the end of the current billing period.
• You can manage your subscription, update payment methods, or cancel at any time through the Stripe Customer Portal, accessible from your profile settings.
• Upon cancellation, your subscription remains active until the end of the current paid period. After that, your account reverts to the Free tier.

7. Prohibited Use

You agree not to:

• Use automated tools, bots, or scripts to scrape, crawl, or extract data from the Service.
• Resell, redistribute, or commercially exploit data obtained from the Service, including meal plans, recipes, or supermarket price data.
• Attempt to reverse engineer, decompile, or derive the source code of any part of the Service.
• Use the Service to transmit harmful, abusive, or unlawful content.
• Create multiple accounts to circumvent free tier limits or abuse promotional offers.
• Interfere with or disrupt the Service's infrastructure, servers, or networks.

8. Intellectual Property

The Service, including its design, code, branding, and original content, is owned by Yummy and protected by applicable intellectual property laws. AI-generated meal plans and shopping lists created for you are yours to use personally, but the underlying technology and algorithms remain our property.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Yummy and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or health outcomes, arising from or related to your use of the Service.

Our total aggregate liability for any claims arising from the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Account Suspension and Termination

• We reserve the right to suspend or terminate your account, with or without notice, if we reasonably believe you have violated these Terms, engaged in abusive behavior, or pose a risk to the Service or other users.
• You may delete your account at any time through your profile settings. Upon deletion, all your personal data will be permanently removed in accordance with our Privacy Policy.
• If your account is terminated by us for cause, you are not entitled to a refund for any remaining subscription period.

11. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of the Service.

12. Changes to These Terms

We may update these Terms of Service from time to time. Material changes will be communicated by posting the revised terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the revised terms.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Spain. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Barcelona, Spain, without prejudice to your rights under applicable consumer protection laws to bring proceedings in your country of residence.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
